Terms of Service

These terms apply to muskofficial.com ("MUSK", "we", "us") and to every order placed through this site, wherever in the world you are shopping from. By placing an order you accept these terms.

1. About us

MUSK is an Australian business based in Queensland, Australia. You can reach us at info@muskofficial.com.

2. Orders

Placing an order is an offer to buy. Our confirmation email means we have received your order, not that we have accepted it. A contract is formed when we dispatch the order. We may decline or cancel an order, including after confirmation, if an item is out of stock, if there is a pricing or description error, if we cannot ship to your address, or if we suspect fraud. If we cancel, you receive a full refund.

3. Pricing and currency

All prices are shown in Australian dollars (AUD) unless another currency is displayed at checkout. If you pay in a different currency, the conversion rate and any foreign transaction fees are applied by your bank or card issuer and are your responsibility. Prices include Australian GST where it applies and exclude international duties and import taxes.

4. International orders

We currently ship to Australia, Canada, New Zealand, the United Kingdom and the United States. You are responsible for making sure the items you order may lawfully be imported into your country. If a parcel is seized or destroyed by customs because the goods are restricted at the destination, we are not able to refund it.

5. Duties, import taxes and customs

Checkout prices do not include customs duties or import taxes. These are set by the destination country and are payable by you on delivery. Refusing to pay them, or refusing delivery, does not entitle you to a full refund - our Return and refund policy explains what we refund in that situation.

6. Delivery and risk

Delivery times shown on the site and at checkout are estimates, not guarantees. We are not liable for delays caused by carriers, customs clearance, weather or other events outside our control. Risk in the goods passes to you on delivery to the address you supplied, and you are responsible for the accuracy of that address.

7. Returns

Our Return and refund policy forms part of these terms: 14 days for Australian orders and 30 days for international orders, with conditions set out in that policy.

8. Products

We do our best to show colours, fabrics and measurements accurately, but screens vary and small variations in dyed or handmade pieces are normal and are not considered faults. Size guides are a guide only.

9. Your account and conduct

Keep your account details secure. You agree not to use this site to break any law, to resell our products commercially without our written agreement, or to interfere with the site's operation or security.

10. Intellectual property

All content on this site, including the MUSK name and logo, photography, text and designs, belongs to us or our licensors and may not be copied or used commercially without our written permission.

11. Liability

Nothing in these terms excludes any rights you have under the Australian Consumer Law or under the mandatory consumer laws of your own country. Subject to that, our liability for any order is limited, at our option, to replacing the goods or refunding what you paid for them, and we are not liable for indirect or consequential loss.

12. Governing law

These terms are governed by the laws of Queensland, Australia, and the courts of Queensland have non-exclusive jurisdiction. If the consumer law where you live gives you the right to bring a claim in your own country, that right is not affected.

13. Changes

We may update these terms from time to time. The version published on the site when you place your order is the version that applies to that order.
